Terms of Service

1. Acceptance

These Terms of Service ("Terms") are an agreement between you and Crew Medya Anonim Şirketi ("Crew Medya", "we"), a company established in Türkiye, regarding the mobile game UP!Terra (the "Game"). By downloading or playing the Game you accept these Terms. If you do not accept them, please do not use the Game. Our Privacy Policy describes how we handle your data.

Türkçe sürüm: Kullanım Şartları. For consumers in Türkiye, the Turkish version prevails.

2. Eligibility

You must be at least 13 years old to play the Game. If you are a minor under the law of your country, you may only use the Game with the consent of your parent or legal guardian, and any purchases must be made or approved by them.

3. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play the Game on devices you own or control, for your own non-commercial entertainment. The Game is licensed, not sold, to you. All rights not expressly granted remain with Crew Medya and its licensors.

4. Accounts

Some features require an account (created anonymously or by signing in with Google or Apple). You are responsible for activity on your account and for keeping access to it secure. You can request deletion of your account at any time via our data deletion page.

5. Virtual items and currency

The Game may include virtual currencies and items (such as coins, boosters or other content) obtainable through gameplay or purchase.
Virtual items are part of the Game and are licensed to you under Section 3; they are not your property, have no real-world value, and cannot be exchanged, redeemed for money, transferred or sold.
We may change, regulate, rebalance or remove virtual items at any time as part of operating and developing the Game.
Except where required by law or by the applicable app store's policies, all purchases of virtual items are final and non-refundable.

6. Purchases

In-app purchases are processed by Google Play or the Apple App Store under their own terms. We do not receive or store your payment card details. Refund requests are handled through the store you purchased from, under that store's refund policy and applicable law. Prices may change; changes do not affect purchases already completed. If you are an EU consumer, by starting the download of digital content immediately you consent to immediate performance and acknowledge that you thereby lose the 14-day right of withdrawal, to the extent permitted by law; the stores implement this consent flow at checkout.

7. Advertising

The Game may display advertisements provided by third parties. Ads are subject to the advertising choices described in our Privacy Policy.

8. Rules of conduct

When using the Game you agree not to:

cheat, use exploits, bots, automation or unauthorized third-party tools, or otherwise manipulate scores or leaderboards;
reverse engineer, decompile, modify or create derivative works of the Game except where the law expressly permits;
interfere with or disrupt the Game or its servers;
use the Game for any commercial purpose without our written permission;
use a display name that is offensive, misleading or impersonates another person; we may reset such names.

9. Intellectual property

The Game and all of its content (code, art, design, audio, names and logos) are owned by Crew Medya or its licensors and protected by intellectual property laws. If you send us feedback or suggestions, you grant us a free, perpetual right to use them without obligation to you.

10. Updates, availability and discontinuation

We may update, change or discontinue the Game or any feature of it (including online services such as leaderboards) at any time. We do not guarantee that the Game or its online features will always be available, uninterrupted or error-free.

11. Termination

We may suspend or terminate your license and access to online features if you materially breach these Terms (for example, by cheating). You may stop using the Game and request deletion of your account at any time. Sections that by their nature should survive termination (including Sections 9, 12, 13 and 14) survive.

12. Disclaimers

The Game is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by law. This does not affect warranties and rights that cannot be excluded under the mandatory consumer protection law of your country of residence.

13. Limitation of liability

To the maximum extent permitted by law, Crew Medya is not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising out of or related to the Game. To the same extent, our total liability for all claims related to the Game is limited to the greater of (a) the amounts you paid us through the Game in the 12 months before the claim arose, or (b) 50 EUR (or its equivalent). Nothing in these Terms limits liability that cannot be limited by law, including liability arising from intent or gross negligence, or your statutory consumer rights.

14. Indemnity

To the extent permitted by the law of your country, you agree to indemnify Crew Medya against claims arising from your breach of these Terms or misuse of the Game.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye. Disputes are subject to the courts and enforcement offices of Istanbul, Türkiye. This does not deprive you of the protection of mandatory consumer law of your country of residence, or of your right to bring proceedings before your local consumer authorities or courts — including, for consumers in Türkiye, the consumer arbitration boards (tüketici hakem heyetleri) and consumer courts.

16. App store terms

Your use of the Game is also subject to the terms of the store you downloaded it from (Google Play or the Apple App Store). Where the Game is distributed through the Apple App Store, Apple's standard licensed application terms apply to the extent required; Apple is not responsible for the Game or its support, and Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you.

17. Changes to these Terms

We may update these Terms from time to time. The current version is always available on this page with its date. For material changes we will provide notice in the Game; continuing to play after the changes take effect means you accept them.

18. Miscellaneous

If any provision of these Terms is found invalid, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Game.
